Effective: September 1, 2026 — Winter Arc Protocol

Welcome to WINTER ARC — an austere system for discipline, habit tracking, and execution. By accessing or using the WINTER ARC website, app, or services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

1 — Acceptance & Eligibility

You must be at least 13 years old to use the Service. By creating an account or using the Service you represent that you have the legal capacity to enter into these Terms. If you use the Service on behalf of an organization, you represent you have authority to bind that organization.

2 — Accounts & Security

You are responsible for safeguarding your account credentials, including Google OAuth tokens where applicable.
You are responsible for all activity under your account. Notify us promptly of any unauthorized use.
We may suspend or terminate accounts that violate these Terms or present a security risk.
Local-only (unauthenticated) data is stored in your browser and is not backed up by us — clear storage and it is gone.

3 — Acceptable Use

You agree not to:

Use the Service for unlawful, harmful, or fraudulent purposes.
Attempt to access, alter, or interfere with the Service, servers, or other users' data.
Reverse-engineer, scrape, or copy substantial portions of the Service without permission.
Upload malicious code, spam, or content that infringes third-party rights.
Abuse rate limits, automation, or any feature in a way that degrades the Service.

4 — User Content & Data

You retain ownership of content you create (habits, tasks, stats, notes, custom cards). You grant us a non-exclusive, worldwide license to host and process it solely to provide the Service.
When signed in with Google, data syncs to our cloud (see Privacy Policy). When not signed in, data stays local to your browser via localStorage.
You may export or delete your data at any time via the Reset function or by contacting us.
We do not claim ownership over your personal discipline data — it remains yours.

5 — Intellectual Property

The Service's brand, design system, copy, and code (excluding your user content) are owned by WINTER ARC and its licensors and are protected by copyright, trademark, and other laws. You may not use our name, logo, or trade dress without prior written consent, except as needed for normal use of the Service.

6 — Third-Party Services

The Service integrates with third parties (e.g., Google OAuth for authentication, Chart.js CDN for the Stat Polygon, Google Fonts). Your use of those integrations is subject to their respective terms. We are not responsible for third-party services.

7 — Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not guarantee the Service will be uninterrupted, error-free, or that habit/goal outcomes will be achieved. The Service is a productivity tool, not medical, psychological, or professional advice.

8 — Limitation of Liability

To the fullest extent permitted by law, WINTER ARC and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of the Service. Our total liability for any claim shall not exceed the amount you paid (if any) for the Service in the 12 months preceding the claim, or $50 USD if no payment was made.

9 — Termination

You may stop using the Service and delete your account/data at any time. We may suspend or terminate your access if you violate these Terms, abuse the Service, or as required by law. Upon termination, your right to use the Service ceases immediately.

10 — Changes to Terms

We may update these Terms from time to time. We will post the revised version with a new effective date and, for material changes, provide notice via the Service or email. Continued use after the effective date constitutes acceptance of the new Terms.

11 — Governing Law

These Terms are governed by applicable laws of your jurisdiction of residence, without regard to conflict-of-law principles, unless otherwise required by mandatory local law. If you are a business customer, the parties agree to submit to the jurisdiction of courts located where the Service operator is established, unless otherwise agreed in writing.
